Terms & Conditions

 

These Terms govern your use of HindCare (the “Platform”), operated by Hindcare Polyclinic & Diagnostic Centre, India. By booking a consultation through HindCare, you agree to the following terms. Please read them carefully before using the Platform.

1. Our Services

HindCare is a platform that connects patients with independent, registered doctors for online and offline consultations. We are a facilitator only — we do not practice medicine, and all medical advice, diagnosis, and treatment is the sole responsibility of the consulting doctor.

The Platform does not constitute medical advice and should not be used as a substitute for professional medical judgment. For emergencies, please contact your nearest hospital or call 108/112 directly.

2. Eligibility and Account Registration

You must be at least 18 years old to create an account and book consultations on your own behalf. If you are booking on behalf of a minor or a dependent, you confirm that you are their parent, legal guardian, or authorized caregiver.

You agree to provide accurate, current, and complete information during registration and booking, and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Booking & Cancellation Policy

No refunds for patient cancellations.
Once a booking is confirmed and paid for, cancellations, no-shows, late arrivals, or rescheduling requests initiated by the patient are non-refundable.

Doctor/platform-initiated cancellations.
If a doctor or HindCare cancels your appointment, you will receive a full refund or a free reschedule, your choice.

Please join online consultations within the grace period or arrive on time for in-clinic visits — late arrivals beyond the grace window are treated as a no-show and are subject to the no-refund policy above.

HindCare reserves the right to reschedule or cancel appointments due to circumstances beyond our control (doctor unavailability, technical issues, force majeure events) and will make reasonable efforts to notify you promptly.

4. Fees and Payments

Consultation fees are displayed at the time of booking and are payable in advance through the Platform. Prices may vary by doctor, specialty, and consultation type (online or in-clinic).

All payments are processed through secure third-party payment gateways. HindCare does not store your card, UPI, or net-banking credentials.

5. User Conduct

When using the Platform, you agree not to:

  • Provide false, misleading, or incomplete medical or personal information
  • Use the Platform for any unlawful purpose or in violation of any applicable law or regulation
  • Harass, abuse, threaten, or behave inappropriately toward doctors, staff, or other users
  • Attempt to gain unauthorized access to the Platform, other user accounts, or HindCare’s systems
  • Use automated means (bots, scrapers) to access or interact with the Platform without our written consent
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

HindCare reserves the right to suspend or terminate accounts that violate these conduct guidelines, without prior notice.

6. Relationship with Doctors

Doctors listed on HindCare are independent practitioners, not employees or agents of HindCare. Each doctor is responsible for their own registration, licensing, and compliance with the Indian Medical Council/National Medical Commission regulations applicable to their practice.

HindCare verifies basic registration credentials of listed doctors but does not guarantee, warrant, or vouch for the quality, accuracy, or outcome of any consultation, diagnosis, or treatment provided. Any disputes regarding medical advice or treatment should be raised directly with the concerned doctor, in addition to notifying HindCare.

7. Patient Privacy & Data

  • Your personal and medical information is kept strictly confidential and handled in accordance with the IT Act, 2000 and the Digital Personal Data Protection Act, 2023.
  • We share your health data only with the doctor you consult, and never sell it to third parties for marketing.
  • Payments are processed via secure third-party gateways; we do not store your card details.
  • You may request access to, correction of, or deletion of your data anytime by writing to [Insert Privacy Email], subject to legal medical record-retention requirements.

8. Intellectual Property

All content on the Platform — including the HindCare name, logo, design, text, graphics, software, and other materials — is the property of Hindcare Polyclinic & Diagnostic Centre or its licensors and is protected under applicable Indian and international intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any part of the Platform without our prior written consent.

9. Limitation of Liability

HindCare is not liable for medical outcomes, diagnoses, or treatment decisions made by independent doctors. Our role is limited to facilitating the connection and booking process between patients and doctors.

To the maximum extent permitted by law, HindCare’s total liability for any claim arising out of or relating to your use of the Platform, where applicable, is limited to the amount paid for the specific booking in question.

HindCare shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of profits, or harm arising from reliance on information provided by doctors through the Platform.

10. Indemnification

You agree to indemnify and hold harmless HindCare, its affiliates, and their respective officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your misuse of the Platform, violation of these Terms, or violation of any rights of a third party.

11. Changes to These Terms

HindCare may revise these Terms from time to time. Material changes will be notified via email and/or a prominent notice on the Platform prior to taking effect, along with an updated “Last Updated” date above. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Mira Bhayandar, Maharashtra.
